Mediation

Mediation is an out-of-court settlement of disputes. It has been operating abroad successfully for decades and contributes substantially and decisively to the rapid out-of-court settlement of civil and commercial cases.

In Greece, according to Law 3898/2010, Mediation means the structured procedure regardless of the name, in which two or more parties to a dispute voluntarily attempt to resolve this dispute by agreement with the assistance of an Ombudsman.

Mediation, in which the parties are represented by their attorney, can be subject to commercial, civil, labor and family disputes, and in general, all private law disputes, if the parties have the power to dispose of the subject matter of the dispute. There are many simple and everyday examples of cases that are best resolved out of court: disputes between apartment building co-owners, monetary claims between merchants or companies, inheritance issues between relatives, etc. Also, parent-child nutrition and communication cases can be resolved and peacefully for the sake of the children. This system contributes to the decongestion of court records, as well as to the smoother and faster settlement of disputes, at a much lower cost, in an environment of legal culture. Given the above, we must all give this institution a chance, trying to resolve our disputes individually and civilized, without marathon litigation, freeing Judges from minor disputes and leaving them time and energy for much more serious issues.
