Real Estate & Property Law

Property law is the set of rules of private law that regulate real rights, that is, the legal relations of persons to things.

When the law does not leave the financial goods to the free use and disposal of everyone, starting from the institution of property, it must be regulated which financial goods can belong to the persons and what powers the person can have over them.

It is this work that performs the law of property by defining the legal forms in which the person rules things, but also regulates the content, the acquisition, the loss, as well as the protection provided by law, while ensuring social peace through to prevent conflicts over the use of things. The content of real law is therefore the domination of economic goods, on which man relies for his survival. That is why the law of property is built on the absolute right of ownership or ownership, the pre-eminent form of domination of goods. After all, the master or owner maintains the exclusive use and free disposition of the thing, where thing means a tangible object, self-existent, impersonal (man is not a thing) and receptive to authority. Essentially Law is defined as a person's relationship to a thing having both a positive and a negative side. The positive side corresponds to the possibility of immediate domination of the thing and the finding of benefits based on it, while the negative side is found in the action of the right against all third party, ie the ability of the beneficiary to exclude any action of a third party on the thing, to impose on all others respect for his authority over the thing, having power over all (erga omnes).
